Arrested in the Nugget   

Bloch's BlogIf Fox's show "The Casino" was staged (as some viewers complain), no one told the Golden Nugget security. They arrested me for trespassing as I was on my way out after dinner there.

After the poker tournament at the Plaza finished for the night, I met a friend who was staying at the Golden Nugget for dinner. We went up to his room briefly so he could check his email, then we went over to the Four Queens across the street to see if another friend was available for dinner (he wasn't -- he was still in a poker tournament there), then we went back to the Nugget and ate at the buffet. When we were done eating at about 10:15, the other friend called and said he was done and on his way over. We left the buffet and went to meet him at the Starbucks in the front of the Golden Nugget. Then I remembered that we hadn't left a tip at the buffet, so we went back to leave the tip. Oops, bad idea.

When we left the buffet again, I was accosted by two Nugget security officers, one in uniform and one plain-clothed. The plain clothed one pulled out his wallet and flashed a badge as though he were a Metro police officer. (Rent-a-cops *love* to pretend they are cops.) He asked me if I had been trespassed at the Nugget before. (Nice work Sherlock! It was on national TV a few weeks ago.) I told him I was just leaving, but he refused to let me leave and had me handcuffed TIGHTLY behind my back. I told him I was at the Nugget visiting a registered guest there, and that I had been invited in the past to play in the poker room.

(In fact, I had been back to the Nugget as many as 10 times since the "trespassing" without incident. I ate at the coffee shop several times, I met with friends and had a couple of business meetings in the hotel rooms, and I played $2-$4 hold'em one night for a couple of hours with some friends who were in town filming a poker show for Fox Sports. One night I saw a show there that included Penn Jillette (of Penn & Teller) as a guest on bass. I used the Nugget valet on at least one occasion, and even shared a ride with some friends in a Golden Nugget limosine.)

Well, the I-wish-I-could-be-an-undercover-police-officer security officer was intent on arresting me for trespassing. They forced me up a hidden staircase to the security office and wouldn't let any of my friends accompany me. They made me sit on a flat metal bench and used a second pair of handcuffs to keep me there. Only after I begged did they loosen the handcuffs. I asked them if I could make a phone call and they refused. I waited until about 11:45 before the Metro police showed up (nice response time!). I requested privacy while the police officer questioned me, which did a lot of good, because when he was done he went into the other room full of security officers to call in my info. The police officer wrote up a citation and had me sign it, promising to appear in court at the end of October. Finally I was free to go.

Well, it wasn't the worst arrest experience I've had, but no arrest is a pleasant experience. It was my first arrest alone, and that does make a difference. Most of the time I was thinking through what I was going to do when I got released. Post a story to my website. Contact a lawyer (probably Bob Nersesian, who has represent other card counters arrested in casinos). I'm willing to fight it all the way up to the Nevada Supreme Court. Maybe contact the press. Maybe Fox would be interested in the story, since it is a counterpoint to the critics who say that Fox's show "The Casino" is staged. Whether or not the Nugget security legally arrested me, their actions don't make the casino look too friendly.

I missed the whole tresspass thing on TV, so forgive my ignorance. Are you not allowed at the Nugget because of the MIT thing, or was it something different? I always had this impression that poker pros were treated pretty well by the casinos. Apparently that's not the case.

While the LVHCM admires your style of marching right back into the Nugget after getting 86'd on national television, you appear to have some terms confused.

You were not actually "arrested" in this case, merely legally detained and aspirated by Nugget security, then issued a citation by one of the true blue boy scouts that compose the Las Vegas Metropolitan Police Department.

"Arrested" would be more like getting feloniously kidnapped by security, then hauled off to jail by the Boys In Blue for disturbing the peace because you yelled for somebody to call the police while you were being kidnapped, then lose your federal civil rights lawsuit vs metro because some morons on a jury feel you should have: "just gone willingly with security and none of this would have happened", convienently ignoring all applicable detention statutes.

You can't make this up...

In your immediate case, a written invitation in your name from the Nugget appears to be your only recourse.

Hi Andy,
I'm a huge fan of yours and think you are pretty hot *wink.* Anyways, I watched the one part of the episode where I thought it was you who got kicked out, they never showed the part of being arrested, just you being escorted to the door, I had tuned into casino just as they were kicking a guy out who looked like you... but I thought you were standing at a black jack table not coming out of a restaurant when they asked you to leave, and they were worried about you card counting, maybe I was assuming but that is what I saw if i remember correctly, it must make you feel important that they look out for you knowing you could win some cash off of them hehehehe. I have another question too, if you don't mind please *smiles.* I would love to play at a table with you on fulltilt, do you have a schedule time that you play on or even a specific table so I can do just that please?? I know you would go easy on me seeing I have only been playing for 5 months in total, such a gentleman u are. *evil grin* Also, someone I played on party poker awhile back and stated they were you, I am assuming now that you have full tilt up and running that it wasn't.... hehehehehe. I look forward to playing with you, poker that is :) Oh and can we post our own pictures on your site here, or is it for VIP members only? *smiles :D*

On TV I was just escorted off the premises. My arrest happened about 6 months after that.

I don't have a fixed fixed schedule on Full Tilt. The next time you see me on there, introduce yourself and I'll play at a new table if I can.

I've never played on Pary Poker, so that wasn't me.

Actually, you were arrested/detained for tresspassing. You admit you were "86'd" and go on to say that you tresspassed on numerious occasions after being 86'd. You state you are going to call an attourney that has handled cases for other "card counters". Buddy you would need an attourney that handles "tresspassing cases". You know, the lowest of the low cases, committed by the lowest of the low people. You are trying to make a mountain out of a mole hill and all the while your words have made you naked. What that means is, if I may expalin it to you, you have exposed yourself as the idoit and asshole that you are. Of course you may need an attourney to explain to you what an idoit you are in a way that you can understand it.

I was arrested for "tresspassing"? Geez, I though I was arrested for "trespassing." I've been contesting the wrong crime!

All kidding aside, a long time ago the charges were dismissed, as are most trespass charges. Trespassing is not a serious offense and people are often arrested for it when the police or property owners wish they could do more to someone, but they can't because they are innocent of any crime of real substance. (Historically, in the common law, there was never a crime of "trespass." You could sue someone who trespassed on your property, but you could not have them arrested unless they committed a crime.)

When I went to court the first time, the judge offered me and just about every other trespassing defendant in the courtroom a deal to plead guilty and receive a $50 fine. She even dismissed the trespass charge against one guy that was caught on railroad tracks. (He claimed he was just jogging. The judge let him off on a technicality.)

I refused the deal and came back to court a couple of months later. I was prepared to fight my case, but the prosecutor offered to dismiss the charges if I "stayed out of trouble" for six months. "Staying out of trouble" meant not getting arrested for trespass or something similar downtown. Axe murdering would have been OK, but disorderly conduct outside the Golden Nugget would have reinstated the charges. Basically, it was a freeroll -- I had nothing to lose by taking the deal. If I stayed out of trouble, the charge would be dismissed. If not, I'd be right back at the same point.

Although I wanted to challenge the application of the trespass law in my case, I was very busy at the time and opted for the dismissal. (As an intelligent gambler, I have a hard time letting freerolls pass me by.)

I haven't been arrested for anything since, and the end of the 6 month period was in May, 2005, over a year ago. The Golden Nugget has also changed ownership since then so I can even go back to the Golden Nugget, although I haven't been back yet.

(By the way, the judge in my case thought that the statute of limitations might limit the length of a trespass warning to 1 or 2 years, but she said not to rely on it because other judges might have a different interpretation.)

sorry bud to hear of this terrible experience similarly being robbed of identity but in my case not being able to see or sue my assailant who stole my 10,000.00 tourney buy in, and talked me into an online casino, some creeps in Canada called future bet,(cant do anything, so i gave up trying, wrote the news stations, tabloids the whole nine, rediculous, So i did the same thing, i built a web site to trash them up and down, exposed pure lies with proof, in relation to the PA incident which prompted your website i would assume, i think they even managed to shut down the site? cause after that time period my web sites cant be updated or revised one was my own personal site for business, and the other was the trashing of this so called online casino company, well its been two years and is all i get on my web pages are errors that read::::::::::::::HTTP Status 500 -

i read that, Thanks Andy, i felt something was wrong when they wanted me to set up bank over seas, but another thing i couldn't do myself without having to send another 1000.00 to the Nevis Bank, at that point i pulled out after sending them 15,000.00 the extra 5000.00 was the player insurance that we had to pay for, insuring our own sites, i got 5000.00 back 2 months later but there bogus set up made them keep my $10G's, a salesman told me he couldn't do anything for me, and was not authorized to do anything at all, I asked him then Why was he cosigner on my faxed contract, tons of lies and bottom line was taking my first bad beat in business, & playing for over 2 years straight hold'em and some omaha has made me a good to decent card player in the long run, with some good advise from Andy & the Boys, will help me to stay motivated! ;-) ESPN OR BUST for me ;-) see you there soon, Thanks again for reading that & for your reply, peace my friend i now watch poker and play it online at FTP every day without fail, i have put some business ventures aside for now and have just stayed focused on my Game.
